Exhibit Space Assignment:

We will make every effort to accommodate your booth assignment requests. However, 2024 National Bariatric Solutions Conference reserves the right to change the booth floor plan if necessary.

Exhibitor Participation:

Exhibitors are not allowed to organize or encourage attendees of the 2024 National Bariatric Solutions Conference to participate in any scientific, technical, informational or other meetings, seminars, events, functions or gatherings outside of the official 2024 National Bariatric Solutions Conference hotel during conference hours.

Hotel Meeting Space:

Exhibitors must provide the 2024 National Bariatric Solutions Conference with details about their meeting space requirements and contact information to request hotel meeting space. Space will be assigned on a first-come, first-served basis. Once the meeting space request is submitted, exhibitors will be contacted by hotel staff to finalize a contract. Food and beverage minimums may apply. If your company cancels the event, you may be liable for cancellation fees to the hotel.

Contract:

Submission of the official Exhibit Space Application and receipt of the exhibit space assignment notification constitute a contract for the right to use the allocated space. Exhibitors understand that they are not contracting for a specific booth but for the right to participate as an exhibitor at the 2024 National Bariatric Solutions Conference. By submitting the application and receiving the notification, exhibitors agree to be bound by all the policies, terms, rules and regulations governing the exhibition, as outlined on this website. The entire contract between exhibitors and 2023 National Bariatric Solutions Conference is defined by your commitment of purchase of exhibit space(s) and sponsorship. Any matter not specified on the website will be resolved at the sole discretion of the Program Director of 2024 National Bariatric Solutions Conference.

Interpretation of Contract:

2024 National Bariatric Solutions Conference has the authority to interpret and amend all policies, terms, rules and regulations contained on the website or any part of the contract. ASPHP's decision as to the meaning and implementation of a policy, term, rule or regulation is final. Exhibitors agree to abide by any policies, terms, rules, or regulations adopted hereafter, which will be incorporated into the contract. If 2024 National Bariatric Solutions Conference changes any policy, term, rule, or regulation after exhibitor acceptance of the contract, written notice will be provided to the exhibitor.

Insurance:

Exhibitors are responsible for maintaining adequate insurance coverage against personal injury, damage or loss of property, data breaches, and failure to meet obligations outlined in the Exhibit Prospectus. Upon request, exhibitors must provide 2024 National Bariatric Solutions Conference with a certificate of insurance indicating at least $1,000,000 of commercial general liability insurance. 2024 National Bariatric Solutions Conference must be named as an additional insured on the policy.

Liability and Indemnification:

2024 National Bariatric Solutions Conference is not liable for personal injuries suffered by exhibitors or their employees, contractors, or business invitees. 2024 National Bariatric Solutions Conference assumes no liability for loss or damage to exhibitor property or injury to exhibitor personnel or invitees unless caused by 2024 National Bariatric Solutions Conference 's gross negligence or intentional wrongful acts. Exhibitors indemnify and hold harmless 2024 National Bariatric Solutions Conference from any claims, liability, damages, or expenses (including attorneys' fees) incurred as a result of exhibitor negligence or wrongful acts or omissions, breach or non-performance of the contract.

2024 National Bariatric Solutions Conference is not liable for indirect, special, or consequential damages resulting from breach of the contract. The exhibitor's sole remedy for breach of contract is a refund of the amounts paid by the exhibitor.

Assignment, Successors, and Assigns:

This contract is binding upon 2024 National Bariatric Solutions Conference and the exhibitor and their successors and assigns. Exhibitors may not assign or transfer any rights or obligations under this agreement without 2024 National Bariatric Solutions Conference's written consent. No assignment releases the exhibitor from its obligations and liabilities under this contract.

Force Majeure:

If the exhibit space is rendered unfit for use due to acts of God, fire, strikes, disaster, political or social boycott, medical epidemic, or other similar unavoidable occurrences, 2024 National Bariatric Solutions Conference will attempt to provide exhibit space at another location. However, 2024 National Bariatric Solutions Conference does not guarantee that it will be able to do so. If the 2024 National Bariatric Solutions Conference is not held at all, the exhibitor's sole remedy is a refund of its exhibit space fees paid.

Audio Visual Components in Exhibits:

Exhibitors may use sound amplification when conducting live presentations, in compliance with the noise abatement policy. Alternatively, wireless headsets may be more appropriate based on the booth size. The noise abatement policy requires that all booth elements must remain within the officially contracted booth space. Live presentations in an open display should use a sound chamber or acoustically contained area to keep the sound level from intruding on any adjacent exhibits. Audio speakers of any kind must be directed toward the interior of the demonstrator’s booth space and may not face aisles or neighboring exhibits. 2024 National Bariatric Solutions Conference reserves the right to determine when sound levels from audio visual equipment constitute interference with others or become unacceptable. Exhibitors are responsible for obtaining appropriate licenses for any copyrighted music used in their exhibit.

Booth Staff:

Exhibits must be staffed each day during exhibit hours until the close of the show at 5 pm on Thursday, Oct 17, 2024. Company representatives are expected to dress and conduct themselves in a professional manner and wear their personal 2024 National Bariatric Solutions Conference -issued exhibitor meeting badge at all times.

Photographing and Videotaping:

Exhibitors are encouraged to photograph or videotape and post onto social media sources their own booth or products before or after Exhibit Hall hours. However, exhibitors understand and agree that additional photographs of their exhibit may be taken by the official show photographer while documenting the conference. Exhibitors agree that photos of their booth, possibly containing logos and trademarks, may appear without restriction on social media sites, and in promotional and other documents produced by 2024 National Bariatric Solutions Conference.

Sales:

The exhibits are intended to further the education of meeting attendees through product and service displays and demonstrations. Order-taking and sale of exhibited products will be permitted, provided the transactions are conducted in an appropriately professional and businesslike manner. 2024 National Bariatric Solutions Conference reserves the right to restrict sales activities that it deems inappropriate or unprofessional.

Penalties:

Each exhibitor agrees to observe all policies, terms, rules, and regulations. In the event of an egregious violation or any repeated failure to observe these policies, 2024 National Bariatric Solutions Conference reserves the right to terminate the exhibit onsite and may refuse assignment of space for future 2024 National Bariatric Solutions Conference events. Breaches or infractions by an exhibitor in any year may be considered by 2024 National Bariatric Solutions Conference, at its sole discretion, in determining whether to close an exhibit onsite or to refuse applications for exhibit space for any future year. If any exhibiting company fails to observe the policies, terms, rules, and regulations outlined in the Exhibit Prospectus, or engages in practices in connection with the event that are deemed unfair or deceptive by 2024 National Bariatric Solutions Conference, at its sole discretion, 2024 National Bariatric Solutions Conference reserves the right to terminate the exhibit onsite and/or refuse assignment of space for future 2024 National Bariatric Solutions Conference events.

Access:

To access the exhibit areas and education sessions, all company representatives must wear their personal exhibitor badge issued by 2024 National Bariatric Solutions Conference at all times while on the premises. The badge should not be altered, defaced, or added to in any way, and a company badge is not acceptable as a substitute for the official badge. Upon request, representatives must present photo identification that matches the name on the badge they are wearing.

2024 National Bariatric Solutions Conference has a zero-tolerance policy for badge swapping. Anyone found swapping badges or wearing a badge that does not match their photo identification will have their badge taken away and be escorted out of the premises.

Exhibitors with their personal 2024 National Bariatric Solutions Conference -issued exhibitor badge may enter the Exhibit Hall two hours prior to the opening of the exhibition and remain there for one hour after it closes. No exhibitor may enter another exhibitor's booth without the other's approval. 2024 National Bariatric Solutions Conference representatives and employees may access any exhibit booth at any time as part of their assigned duties.
